1. Acceptance of Terms
By accessing or using the Glitz mobile application (“App”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
2. Description of Service
Glitz is a marketplace that connects companies (product providers), influencers (content creators), and buyers (shoppers). Companies list products, influencers promote them through personalized tracking links and content, and buyers purchase products through influencer recommendations.
3. User Accounts
You must create an account to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account. Access to influencer and company accounts may require an invite code or application approval.
4. User Types
The App supports three user types: Buyers, Influencers, and Companies. Buyers can browse and purchase products. Influencers create promotional content, share tracking links, and earn commissions on sales they drive. Influencers may form or join teams to promote products collectively. Companies list products, set commission rates, and manage collaborations with influencers. Companies may connect external services such as Shopify to sync product catalogs and fulfill orders. Each user type has specific responsibilities within the platform.
5. Payments and Commissions
Payments are processed through Stripe. Companies set product prices and commission rates, which may vary by product category or individual product. Influencers earn commissions on sales made through their tracking links or team links. Commissions are held for 30 days after purchase to allow for returns and refund processing, then released automatically. If a purchase is refunded during the hold period, the associated commission is cancelled. Transaction and sales records are maintained permanently and cannot be deleted to ensure financial integrity. All payment disputes should be reported to our support team.
6. Taxes
Glitz does not collect or remit sales tax on behalf of sellers. Companies listing products on the platform are solely responsible for determining, collecting, and remitting any applicable sales taxes, value-added taxes, or other transaction-based taxes required by law in their respective jurisdictions. Influencers and Companies receiving payouts are responsible for reporting income and paying any applicable income taxes. Stripe may collect tax identification information (such as W-9) during account onboarding and may issue tax forms (such as 1099-K) as required by law.
7. Tracking Links and Attribution
Influencers receive unique tracking links for products they promote. When a buyer purchases through a tracking link, the sale is attributed to the referring influencer for commission purposes. Referral links used during signup may attribute the new user to the referring influencer. You agree not to manipulate, spoof, or abuse tracking links or referral attribution.
8. Prohibited Conduct
You agree not to: (a) violate any applicable laws; (b) infringe on intellectual property rights; (c) post false or misleading content; (d) engage in fraudulent activities; (e) harass other users; (f) attempt to gain unauthorized access to the App; (g) manipulate tracking links or commission attribution.
9. Content Ownership
You retain ownership of content you create. By posting content, you grant Glitz a non-exclusive license to use, display, and distribute your content within the App. You are responsible for ensuring you have rights to any content you post.
10. Termination
We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time through the App settings.
11. Disclaimers
The App is provided “as is” without warranties of any kind. We do not guarantee the accuracy of product listings or promotional content. We are not responsible for transactions between users.
12. Limitation of Liability
To the maximum extent permitted by law, Glitz shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
13. Changes to Terms
We may update these terms at any time. Continued use of the App after changes constitutes acceptance of the new terms. We will notify users of significant changes.
